Terms of service

These terms apply when you buy from or use togoandstark.com. By placing an order you agree to them.

Togo & Stark is a trading name of Tagus Group LLC, a limited liability company registered in the State of Wyoming, United States. Our registered address is 30 N Gould St, STE R, Sheridan, WY 82801, USA.

Ordering

Placing an order is an offer to buy. A contract forms when we confirm your order by email. We may decline or cancel an order and refund you in full, for example if we cannot make a usable portrait from the photo supplied, if an item is mispriced, or if we suspect fraud.

Prices are in US dollars. We may change prices at any time, but not for orders already placed.

Your photo

When you upload a photo you confirm that you own it or have permission to use it, and that we may use it to make your portrait. Please do not upload photos taken by a professional photographer without their permission. The copyright in a photo usually belongs to the photographer, not to the owner of the pet in it.

You keep all rights in your original photo. We use it only to produce your order, and to provide customer support relating to it.

Showing your portrait in our marketing

We would like to be able to show finished portraits, the artwork rather than your original photo, on our website and social media. If you would rather we did not, tell us at any time and we will not, and will remove it if we already have. Just contact us; you do not need to give a reason.

We will never show your original photo, only the finished artwork, and we will never publish your name, your pet's name or any order detail alongside it without asking you first.

Content we will not print

We may decline to make a portrait from any image that is unlawful, infringes someone else's rights, or depicts content we are not willing to reproduce. We will refund you in full if we decline.

How your portrait is made

Your portrait is created using our own AI illustration process, working from the photo you upload and the style you choose. A person then reviews every portrait before you see it, and nothing is printed until you have approved the proof. We do not describe our portraits as hand-drawn or hand-painted, because they are not.

Each portrait is an interpretation of your photo in the style you choose, not a photographic reproduction. We send you a free proof before printing precisely so you can judge the result before committing.

Rights in the artwork

We own the copyright in the artwork we create. You get an unlimited personal, non-commercial right to use it: hang it, photograph it, post it, give it away. You may not resell it, license it, or use it commercially without our written permission.

Accounts

If you create an account, you are responsible for keeping your login details secure and for activity under your account.

Our liability

We are responsible for supplying your order as described and with reasonable care. We are not liable for losses that were not reasonably foreseeable, or for business losses. Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else which cannot lawfully be limited.

Except where the law does not allow it, our total liability to you for any order is limited to the amount you paid for that order.

What we do not promise

The site itself is provided as it is. We do not promise that it will always be available or free of errors, and we are not responsible for other websites we link to.

If you cause us a loss

If we suffer a loss or a claim because you uploaded a photo you did not have the right to use, or because you used the site unlawfully, you agree to cover the reasonable costs that causes us. This is the practical counterpart of the photo permission you give above.

Using the site

Please do not use the site to break the law, to infringe anyone's rights, to upload anything harmful, or to interfere with how the site works. We may suspend or close an account that does.

Governing law

These terms are governed by the laws of the State of Wyoming, United States, and any dispute will be dealt with by the courts of that state.

General

If any part of these terms turns out to be unenforceable, the rest still applies. These terms, together with our refund, shipping and privacy policies, are the whole agreement between us.

Changes

We may update these terms. The version in force is the one published here when you place your order.
